These Terms constitute a legally binding agreement between you and SupportVest ("we," "our," or "us"). We reserve the right to modify these Terms at any time. Your continued use of the Services after any changes indicates your acceptance of the new Terms.

SupportVest is a financial literacy education platform that provides:

Interactive financial education lessons and quizzes
Gamified learning experiences with virtual currencies (VestCoins, FinIQ)
Progress tracking and personalized learning paths
Leaderboards and competitive features
Portfolio simulation tools for educational purposes

3. User Accounts

To access certain features, you must create an account. You agree to:

5. Virtual Currency

Our Services include virtual currencies (VestCoins, FinIQ) that are:

For entertainment and educational engagement only
Not redeemable for real money or monetary value
Non-transferable between users
Subject to modification or removal at our discretion

Virtual currency has no real-world value and cannot be exchanged, sold, or transferred outside the Services.

6. Subscription Services

We offer subscription plans with enhanced features. By subscribing, you agree to:

Pay the applicable subscription fees
Automatic renewal unless cancelled before the renewal date
Cancellation through the platform where you subscribed (Apple App Store or Google Play)

Subscription fees are non-refundable except as required by applicable law or as specified in the app store's refund policies.

7. User Conduct

Violate any applicable laws or regulations
Impersonate any person or entity
Interfere with or disrupt the Services
Attempt to gain unauthorized access to any systems

8. Intellectual Property

9. SMS/Text Messaging Terms

If you opt-in to receive SMS messages from SupportVest:

You consent to receive automated text messages related to your account, learning progress, and promotional content
Message frequency varies based on your activity and preferences
Message and data rates may apply based on your carrier plan
You can opt-out at any time by replying STOP to any message

Carriers are not liable for delayed or undelivered messages

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Services will be uninterrupted or error-free
Defects will be corrected
The Services are free of viruses or harmful components
The educational content will meet your specific learning objectives

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPPORTVEST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the Services
Any unauthorized access to or alteration of your data
Any financial decisions made based on educational content
Any third-party conduct on the Services

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless SupportVest, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

13. Third-Party Services

Our Services may contain links to or integrate with third-party services. We are not responsible for the content, privacy policies, or practices of third-party services. Your interactions with third parties are solely between you and such parties.

14. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for any reason, including breach of these Terms. Upon termination:

Your right to use the Services ceases immediately
Virtual currency and progress may be forfeited
Provisions that should survive termination will remain in effect

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Fulton County, Georgia.

16. Dispute Resolution

Any dispute arising from these Terms or your use of the Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SupportVest regarding the use of our Services.
